HOUSTON (FOX 26) -
A young girl, whose 9-year-old sister was found dead in a refrigerator drawer, will now be staying with her paternal aunt.
The girl's mother was not in court for the hearing on Thursday, but the father and his relatives were. Child Protective Services still has custody of the 5-year-old girl.
The father will only be allowed to visit his daughter at CPS if he passes a drug test.
An attorney for the girl's father says he was calling his special needs, non-verbal, daughter and had no idea she had been dead since January.
"For months, he had been talking to her over the phone and singing to her at night and letting her hear his voice and he was told by Ms. Keyes the entire time she enjoyed those calls," said attorney Dennis Slate. "He was devastated when he found out."
CPS is not allowing the 5-year-old girl's mother any visitation. She has not been charged in connection with the 9-year-old girl's death.
