Arizona asks top court to reverse execution ruling

TUCSON, Ariz. (AP) - The state of Arizona is asking the U.S. Supreme Court to reverse a lower court's ruling and allow an inmate's execution scheduled for Wednesday to proceed.

Attorney General Tom Horne's office filed the 23-page request Monday afternoon after the 9th U.S. Circuit Court of Appeals refused to overturn an earlier ruling that put Joseph Rudolph Wood's execution on hold. The appeals court said the state must reveal details of how it will handle his death and who makes the drugs that will be used.

It marked the first time an appeals court has delayed an execution over drug secrecy.

Wood argues he has a First Amendment right to the details and that the information is beneficial to the public.

The Supreme Court could rule as early as Tuesday afternoon.
