Houston police are investigating the deadly shooting of a robbery suspect by an off-duty officer.
The incident took place on Sunday night on West Gulf Bank Road near the North Freeway.
Officer C. Rodriguez was off duty in his private truck when he observed two men lurking behind a garbage bin outside a convenience store.
The officer found the situation to be suspicious which led him to drive back to the store.
"Before he knows it, he sees them assaulting and beating the victim," said spokesperson John Cannon. He also said the officer ordered the men to stop.
When one of the men approached the officer while holding a gun, the officer opened fire and the shot struck that man. The man ran away from the officer and collapsed. He later died at the crime scene.
Police caught the other man a short time later and recovered a weapon.
"Obviously, like we do in any other case, we will do testing on it to see if it comes back, see how it was purchased or if it was stolen," said Cannon.
The homicide and internal affairs division as well as the Harris County District Attorney's office are investigating.
