Man dies on LIRR track after attack

BELLMORE, N.Y. (AP) — Police say a 34-year-old New York man has been arrested and charged with murder for his role in an assault that left another man dead on the tracks of the Long Island Rail Road.

The Metropolitan Transportation Authority and Nassau County Police say Saturday Niheim Levy was in a verbal dispute with the 49-year-old victim that turned into a physical altercation.

Niheim was in custody Saturday and not available for comment. Lawyer information was not immediately available. Police say he was also charged with robbery.

Police had initially said the victim may have suffered a seizure, falling onto the third rail at the Bellmore LIRR station during the 4:50 a.m. incident.

The victim's name was being withheld pending family notification.

The LIRR says trains are now running as normally scheduled.

    An ex-convict suspected of gunning down a Nassau County police officer and then fatally shooting a carjacking victim was found guilty on all counts in the murders on Monday. Darrell Fuller, 33, shot and killed Police Officer Arthur Lopez in October 2012 who suspected he had been involved in a hit-and-run car accident. Authorities said Fuller then fled that shooting and killed the second victim, Raymond Facey of Queens, while stealing his vehicle.
