At the Fiesta Mart on Jensen, the remnants of a parking lot gun battle told a grim story.
Beneath a green tarp lay a dead man, and on the ground in clear sight was a semi-automatic pistol. Inside an HPD cruiser sat the man police say fired the fatal bullet and wounded a second alleged attacker.
"We're pretty sure that someone was trying to car jack someone at this location," said Sgt. Christy Smith with the Houston Police Department homicide division.
It all happened at around 10:15 in the morning.
When gun shots rang out, the security guard at Fiesta Mart alerted police and charged to the parking lot taking one of the men into custody.
Yolanda Fuentes car was struck by gunfire and her children ducked for cover in the back seat.
"I was afraid for my kids, not for me," said Fuentes in Spanish.
While police are calling the incident an attempted car jacking, they've yet to reveal whether the attackers had more in mind than stealing a car or whether the man who killed one and wounded another was acting purely in self defense.
"We're not ready to say until we get further into our investigation on who is a suspect and who is a complainant in this situation," said Smith.
Smith says the wounded man was taken to LBJ hospital for treatment.
