He says, "we received a $250 settlement offer at the very beginning...once we rejected the offer we had to sue the city."
Krell says Houston is self insured - meaning it pays its own insurance claims...He says that makes it a tough fight for people like the Langfords.
"The city has built in protection that an insurance company doesn't have - they have sovereign immunity so to sue the city you have to jump through extra hoops that aren't there for the insurance companies," says Krell.
In the meantime, Cody is still catching rides to work and school while his dad is disappointed.
"I just want to let your listeners know in Houston you need to stay away from city vehicles cop vehicles," said Glen.

According to city legal, the settlement was accepted, but the complainant has never returned the paperwork needed to process the payment.
