Tonight one of three suspects involved in a car chase that ended with a fatal crash is free.
Ashley Howard, who was not the alleged driver in the accident, walked out of the courtroom but not before
apologizing to the Mendez family.
Howard has now been formally charged with felony theft and evading arrest.
"It was an accident, what more can we say .... we apologized" said a very tearful Howard
as she left court with her family and close friends at her side.
It was obvious she'd been injured following last week's crash because she was on
crutches but despite
her pain she expressed her sadness and remorse for the family who lost a mother of three.

It happened at Quitman and 59, detectives say, Franklin and her two passenger Howard and Raquel Gonzalez
blew through a red light and hit the families car.
According to police this was minutes before leading them on a chase.
"She's just sorry , my momma talk to her every day she just made a horrible mistake" said Yvette Blackwell
about her niece Shiquinta Franklin. The 21-year-old is the alleged driver who also stood before a
judge today, handcuffed and wearing an orange jumpsuit before facing a count of murder.
"She's not a murder, she's a really good person but we are just so saddened for the family because
now those kids have to grow up without a mama." Over 26-hundred dollars worth of stolen merchandise, that's
why the police were after the trio.
But now they're accused of stealing a precious life.
