Sources: Grand jury to hear evidence in APS cheating scandal soon

ATLANTA -

Prosecutors could begin a grand jury hearing into the Atlanta school cheating scandal any day now. Sources tell FOX 5 the Fulton County District Attorney's office will take up the case by the end of the week.

The grand jury will decide whether criminal charges should be brought against educators identified in the investigation.

Criminal defense attorney Bruce Harvey represents six principals named in a state investigation into the cheating.  Harvey says he welcomes the scandal moving into a new arena.

"Now if we get some indictments or we get some formal charges, now we finally get to hopefully a neutral playing field," Harvey said. "We're going to be able to confront the witnesses and we're going to be able to knock down the running backs on the other side."

The cheating scandal has been in the headlines for nearly four years.  It cost then-Superintendent Dr. Beverly Hall her job.
      
Attorney Gerald Griggs represents nine other educators under a cloud.

"You may be able to get an indictment, I doubt very seriously on my teachers you will be able to get a conviction," Griggs said.

Immunity deals negotiated more than a year ago, by state investigators Michael Bowers and Bob Wilson reportedly will be honored.

Harvey says his concern is that prosecutors may bend to political pressure and overcharge educators.

"We take what is a small problem and make it sound overwhelming, large, and conspiratorial.  It simply is not that," Harvey said.

A source told FOX 5 that cases against teachers, principals and district administrators will be presented. It is not yet known if Hall's case will be included with these cases.

Hall's attorney did not return a request for comment.
