Around 7 p.m. Tuesday, Houston police department received information that 4-month old Stephanie Lavette Phillips and 32-year old Byron Gee, the accused abductor, were be at the Mariner Inn, located at 1602 Seawall Blvd.
The two were the subject of an amber alert issued early Tuesday morning.
According to Galveston police department spokesperson Lt. Michael Gray, Galveston police officers were contacted and, along with the U.S. Marshall's, made entry into the motel room.
According to Gray, officers located the 4-month old child alone inside the motel room. The child appeared to be unharmed.
Lt. Gray says Gee fled to a nearby neighborhood. Officers dispatched K-9 officers to the area and a perimeter was set up.
Gray says that an officer who walking the perimeter of the search area located a suspect who matched the description of Gee and that person was taken into custody.
The child was transported to an area hospital to be checked out.
Gee is currently in the custody of Galveston Police. He has been charged with robbery with bodily injury and kidnapping in 177th district court.
Gee has a criminal record that dates back to 2000 with charges ranging from assault to theft.
He will be transported back to Houston sometime tonight.
It was around 4:30 Tuesday morning when HPD investigators say Gee disappeared with 4 month old Stephanie Phillips.
The baby, who's not Gee's biological child, was allegedly taken from this West Bellfort apartment.
The child was with her mother Carolyn Phillips who is Gee's girlfriend.
Mike Cervantes lives in the complex.
Cervantes says, "he got into an argument with his gal and I guess he snatched up the baby and took the baby... "
John Bahta was in apartment near the home of the missing child. He says he heard screams at 4 in the morning... all he did was rolled back over in his bed. He says he expects screams in the complex that's why he wants his father to move out.
Bahta says, "I don't even know because I went back to sleep after that it could've went on all night I just woke up I woke up now."
An amber alert has been issued for the child and police still say Gee eludes them.
He was last seen running from the complex just off West Bellfort wearing all black with no shoes...
Cervantes says, "he got some woman across the street for her car I guess he carjacked some woman."
Cervantes went on to say, "I just hope he doesn't hurt that bad he's already in a world of trouble...he needs to do what's right and turn that baby in at a fire station or somewhere."
Gee was last seen in that white Ford Expedition with Texas License plate DK3N645.
