Charges dismissed against original Lone Star College shooting suspect

HOUSTON (FOX 26) -

Prosecutors have dropped assault charges against a man who was among three people wounded in a shooting at a Houston-area college.

Carlton Berry was arrested soon after the Jan. 22 shootings at Lone Star College and charged with two counts of aggravated assault with a deadly weapon. Berry was shot in the leg.

Sara Kinney, a spokeswoman for the Harris County district attorney's office, said Monday that Berry was clearly a victim.

Another man wounded in the incident told investigators that he bumped into Trey Foster on campus, sparking an argument that escalated into gunfire. A maintenance worker also was wounded.

Harris County Sheriff Adrian Garcia conducted a news conference at 2 p.m. Monday to respond to the charges dismissed against Berry. During the conference, Garcia said that had charges not been filed against Berry, authorities would not have caught Foster.

The 22-year-old Foster is charged with two counts of aggravated assault with a deadly weapon. He also is charged with resisting arrest in an earlier case.
