Mom fuming after 12-year-old arrested for improper photography

A Channelview ISD student said she was arrested in front of her teachers and classmates and is now facing charges because of a picture she took on her cell phone.

The girl and her mother, who did not want to be shown on camera, say the 12-year-old used her phone to take a picture of herself with some friends in a locker room at Alice Johnson Junior High School.

Turns out, she also captured the image of a naked classmate in the background.

The 12-year-old said she immediately deleted the photo and it was never emailed or posted.

Her mom said the situation should have ended there.

"Next thing, I get a phone all saying she was arrested and the parents are pressing charges, and the officer came to the school and he arrested her," the mom said.

"They took me to the cop car and told me to put my hands behind my back," the 12-year-old said.

"I'd say this is akin to a child being kicked out of school for buying an aspirin," attorney Jack Carroll said.  "It reminds me of the overreactive, overzealousness by school districts."

The Harris County Precinct 3 Constable's Office says the girl was charged with improper photography.

A Channelview ISD representative says the district is cooperating with the investigation.
