Gillispie's Atty: Someone's Lying in KY

HOUSTON - Before a federal court in Texas or in Kentucky will determine whether or not former Wildcats coach Billy Gillispie is owed at least $6 million by his former employer, it must decide who his employer is.

It's either the University of Kentucky, whose Wildcats team Gillispie was head coach of for two years, or it's the University of Kentucky Athletic Association, the non-profit entity that runs UK athletics.

And that's a big deal because if the school is the employer, it has immunity against certain types of claims, including fraud. Also, UK cannot be sued in Texas where Gillispie filed his breach of contract suit. So the lawsuit would have to be moved to Kentucky and the school would get the home court advantage.

The University has filed motions in court rooms in Texas and Kentucky to do just that.

Gillispie filed suit against UK for firing him two years into a seven-year contract alleging the school still owes him at least $6 million. UK officials contend the two sides did not have a written contract, so their former coach shouldn't get a dollar.

Meanwhile, there is the matter of who signed Gillispie's checks.

His attorney is now revealing documents that appear to answer that question beyond a shadow of a doubt.

Demetrios Anaipakos said the UKAA filed tax returns in 2006 and 2007 that list Gillispie as its highest-paid employee.

"So they both can't be telling the truth," Anaipakos said in an interview Wednesday with FOX 26 Sports. "Either the University of Kentucky is lying to the court in Kentucky and the court in Dallas when it said that it was Coach Gillispie's employer or the UKAA lied to the IRS in 2006 and 2007 when it said it was Coach Gillispie's employer.

"It's just more examples that the University of Kentucky can't get its story straight and that's what happens when you don't tell the truth."

Like a good television soap opera, stay tuned for the next twist and turn.

With the revelation of the UKAA tax documents, it would seem Coach Gillispie is not the one twisting right now.
